Trump and Green Card: Will Trump Affect My Green Card Case?

Trump and Green Card:

Everyone is wondering if Trump will affect their green card cases regardless of the type of their immigration case. There are different types of green card cases such as employment-based, investment-based, family-based including marriage-based, asylum-based, etc. What are the changes in these green card cases since Trump took office? Not much yet.

Through his fear tactic, Trump is terrorizing the immigrant families with mixed legal statuses (e.g., parents with no legal status while the children are U.S. citizens). Since his inception as the President, we have been getting inquires from both legal and illegal aliens. Fortunately for legal green card processing cases, however, there hasn't been a substantial change worth discussing. There are ominous things percolating but thus far, the legal aliens are in the safe zone...for now.

For those in America without legal status, however, the danger of Trump presidency can be more imminent. We've heard of a DACA recipient (those who entered the U.S. as a child, grew up and graduated from high school, living as a law-abiding resident who were eligible to receive a work permit under the Obama administration) being detained like a criminal for no other reason than the fact that she's been in the U.S. without documents. There have been travel bans for people from certain countries. When the first of these bans failed to pass muster with the courts, Trump issued a second, "revised" version which is to take effect on March 16, 2017. Several states including Hawaii, Minnesota, New York, Oregon are poised to fight the second travel ban on constitutional grounds similar to the first travel ban.

As the Trump administration becomes more erratic and unpredictable, we, the immigration professionals, are unsure what would come next. What we can say is, though, please file your green card case immediately if you are eligible.

Whether your green card case is based on marriage, employment, investment, or something else, this is not the time to wait. Not doing anything can mean inability to work for a prolonged period of time or being separated from your family for an indefinite time period.
